RELEASE WAIVER
In consideration of being allowed to participate in the NISED event referenced below, I hereby release, hold harmless, and covenant not to sue NISED, each and every officer, agent, and employee (hereinafter collectively referred to as (“NISED”), from all claims, causes of action, or demands of every kind which I may have in the future or that any person claiming through me may have in the future against NISED by reason of any injury to person or property, or death, in connection with my participation in the below-described activity. I am aware of the risks of choosing to participate in this activity and voluntarily choose to participate in this activity. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, which may be sustained by me as a result of participating in this activity. I agree to indemnify NISED for any claims, causes of action, or demands that may arise from my participation in this activity.
COVID-19 LIABILITY WAIVER
I hereby acknowledge the contagious nature of the Coronavirus/COVID-19 and that the Centers for Disease Control and Prevention (CDC), local governmental agencies, and other health authorities recommend various measures to prevent its spread. I further acknowledge that the National Institute for Social Emotional Development, Inc. (NISED) cannot guarantee against potential exposure to and spread of Coronavirus/COVID-19 at any of its in-person programs and/or events. By accepting this waiver, I understand, acknowledge, and assume the risk of potential exposure to Coronavirus/COVID-19 (including its variants) at NISED’s in-person programs and/or events. Based on my understanding, acknowledgment, and assumption of risk, I hereby release NISED, its officers, directors, employees, and agents thereof, and/or other attendees from all claims, demands, damages, costs, or liabilities (collectively “Claims”) arising from or relating to my participation, attendance or other involvement with NISED’s programs and/or events, including, without limitation, any Claims related to exposure to, infection with, or spread of COVID-19 (including its variants). I agree to forego all rights to sue NISED, its officers, directors, employees, and agents thereof, and/or other attendees for any reason related to or arising from my participation, attendance, or other involvement with NISED’s programs and/or events, including, without limitation, any Claims related to exposure to, infection with, or spread of COVID-19 (including its variants), and assume all risks associated with my attendance. This waiver, assumption of the risk, and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
PHOTO RELEASE
I hereby authorize the National Institute for Social Emotional Development, Inc. (NISED) and those acting pursuant to its authority to: (i) photograph, record, film, live stream, or capture my likeness and/or voice in any photographic, digital, audio, video, electronic or other media now available or hereafter developed; and (ii) distribute, broadcast, use, reproduce, exhibit, or otherwise globally disseminate, in perpetuity, such media without any further approval from me or any payment to me. This grant to NISED includes the right to modify such media, use the media alone or together with other information, and allow other third parties to use or disseminate the media in furtherance of NISED’s mission. I hereby release and waive any claims or rights of compensation or ownership regarding such uses and understand that all such materials shall remain the property of NISED. I certify that I am 18 years of age or older or that my parent/guardian accepts the waiver contained herein.
